The report of the Auditor and Treasurer of state have been pre¬ sented to Die House of Ilepresentalives, and ordered to be printed.
An cn;;rossed bill to amend the act, entitled *^an act regulating th*^ times of holding judicial courts, passed February first,; 1822, was read a third time.
Resolved that said bill do pass, and that the title thereof be, "an act to amend the act, entitled **an act regulating the times uf holding judicial courts, passed February first, 182£.
Ordered that said bill be sert to the House of Representatives, and their concurrence therein requested.
Mr. Morris moved the adoption ofthe following resolution.
Resolved by the senate and House of Representatives, that the sen- ate meet in the Representaties' Hall on the day of December instant, at three o'clock P. M. on said day,€ind that the speaker then and there open and publish the returns of election lor Governor agreeably to ihe second section ofthe second article of the constitu¬ tion of this state.—Which resolution was read and ordered to lie on the table.
Mr. Scofield from the committee appointed to wait on his excellen¬ cy the acting Governor, reported that said committee had pcrfoiined the duties assigned them, and received for answer, that his excellen¬ cy would on to day at three o'clock, P. M. make a communication t^ both houses of this General assembly, by a message in writing.

The duties of the Exccntive branch of tlie Government liavini,^ hy 5 provision in the Constirution, devolved on me, as p^sidihg- orficer «fthe Senate, from the period of Governor Brown's resignation in f^ecember last; it becomes necessary in the discharge of those du¬ ties, to communicate ^o the Legislature on the present occasion, ^the state ofthe Government,' what information I possess upon those sub¬ jects, which may demand their immediate attention, and the manner m which those special duties assigned the Executive by laws aii'! res¬ olutions ofthe last annual session have been performed.
